General terms and conditions of sale — Trainings
Article 1 — Object and scope
These General Terms and Conditions of Sale (T&Cs) apply to all professional trainings offered by JDUCRAFT (EURL, SIREN 881 733 356), a training organization registered under activity declaration number 11757016575 with the Préfet of the Île-de-France region. Qualiopi-certified training organization.
Any training order implies unreserved acceptance of these T&Cs.
Article 2 — Registration
Any registration is confirmed by sending a signed training agreement (or training contract for individuals) and the corresponding purchase order. Seats are limited and allocated in the order of registration. A practical-information notice (location, schedule, access) is sent to the trainee at most 7 working days before the training starts.
Article 3 — Pricing and payment
Prices on the website are in euros excluding tax (HT) per person. VAT at the prevailing rate (20%) is added. Prices include the training itself, course materials and the training completion certificate. Trainees' travel and accommodation costs remain at their charge.
Payment is due upon receipt of the invoice, with a 30-day payment term from the issue date. Late payments will incur penalties at the legal interest rate plus 3 points, plus a flat recovery fee of €40 (articles L441-10 and D441-5 of the French Commercial Code).
When funded by an OPCO, it is the client's responsibility to file the request with their OPCO before the training starts. In case of partial funding, the remainder is invoiced directly to the client.
Article 4 — Withdrawal period
In accordance with article L6353-5 of the French Labor Code, an individual trainee has a 10-day withdrawal period from the signing of the training contract, by registered letter with acknowledgment of receipt. No payment can be required before this period expires.
Article 5 — Cancellation and rescheduling
Any cancellation must be made in writing (email or letter).
- Cancellation more than 15 working days before the start: no fee.
- Cancellation between 15 and 10 working days before the start: 30% of the amount is due.
- Cancellation less than 10 working days before the start: 50% of the amount is due.
- No-show or cancellation on the day of the training: 100% of the amount is due.
Replacing a participant is possible at no cost up to the day before the training, provided the new participant meets the prerequisites. A session can be rescheduled once at no cost, subject to availability.
JDUCRAFT reserves the right to cancel or reschedule a session due to insufficient participants (minimum 3). Registered trainees are then informed at least 7 working days in advance and offered a new date.
Article 6 — Training delivery
Trainings take place on-site or remotely as specified in the program sheet. Standard hours are 9:00 AM to 5:00 PM (7 hours per day), including a one-hour lunch break. JDUCRAFT reserves the right to adjust the schedule by mutual agreement with the client.
Article 7 — Obligations of the parties
JDUCRAFT's obligations:
- Deliver the training diligently and in line with the announced program.
- Provide adequate course materials.
- Make available a qualified, competent trainer.
- Issue a completion certificate and an attendance sheet.
- Assess the learning outcomes.
Client / trainee obligations:
- Ensure that prerequisites are met before the training starts.
- Have the required technical equipment (specified in the program sheet).
- Respect the schedule and internal rules.
- Sign the attendance sheet.
Article 8 — Completion certificate
At the end of each training, a completion certificate is issued to each trainee, mentioning objectives, nature, duration and the assessment results.
Article 9 — Intellectual property
All course materials provided during the training (presentations, exercises, source code, documentation) remain the intellectual property of JDUCRAFT. Any reproduction, distribution or commercial use is forbidden without prior written agreement. The trainee is granted a personal and non-transferable usage right.
Article 10 — Liability
JDUCRAFT undertakes to use all means necessary to deliver the training properly (best-efforts obligation). JDUCRAFT cannot be held liable for damage resulting from force majeure or from the trainee's actions. In any case, JDUCRAFT's liability is limited to the amount of the training concerned.
Article 11 — Force majeure
Neither party can be held responsible for failure to meet its obligations in case of force majeure as defined in article 1218 of the French Civil Code (natural disaster, pandemic, strike, major internet outage, etc.). The training will then be rescheduled to a later date agreed by the parties, with no penalty.
Article 12 — Complaints and mediation
Any complaint regarding a training can be sent by email to jdu@jducraft.com or via the online complaint form. JDUCRAFT will acknowledge receipt within 48 working hours and reply within 15 working days.
In case of an unresolved dispute, the client can refer free of charge to the consumer mediator: CNPM — Médiation de la consommation, 27 avenue de la Libération, 42400 Saint-Chamond — cnpm-mediation-consommation.eu.
Article 13 — Internal rules
Each trainee agrees to respect the internal rules of the training organization, communicated before the training starts. The internal rules define hygiene and safety requirements, disciplinary measures and trainee representation in accordance with articles L6352-3 to L6352-5 of the French Labor Code.
Article 14 — Qualiopi certification
JDUCRAFT is a Qualiopi-certified training organization. This certification allows trainings to be funded by OPCOs.
Article 15 — Governing law and jurisdiction
These T&Cs are governed by French law. In case of dispute, failing amicable resolution or mediation, the courts of Paris shall have sole jurisdiction.
